Frequently asked questions
Short answers to the questions we are asked most. If yours is not here, call or email and ask.
What does debt recovery cost?
Our commission is charged on what we recover. There is no joining fee, no monthly fee and no upfront fee. We give you the figure before you commit. Court filing fees and similar out of pocket costs sit outside commission, and we tell you what they are before anything is spent. Our rates.
What happens if you do not recover anything?
If we do not recover, you do not pay commission. Where an account is not worth pursuing, we say so as early as we can.
Can the debtor be made to pay the recovery costs?
Often, yes. Where your terms of trade allow recovery costs to be charged to the debtor, we claim them. If your terms do not say so, it is worth changing them for the future.
What do you need from me to start?
The unpaid invoice or a statement of the account, your terms of trade or the signed credit application, and any correspondence with the debtor. Lodge the debt online, or email them to admin@nzdebtrec.com. We review them and tell you whether the debt is recoverable and what it will take, at no cost and with no obligation. There is no joining fee and no monthly fee; our terms of business set out how we act.
Do I have to go to court?
Often not. Many accounts resolve after a demand or a negotiated arrangement. Where court is needed, we tell you why, which forum fits, and what it will cost before anything is filed. See Disputes Tribunal vs District Court.
The debtor says they dispute the invoice. Can you still help?
Yes. Disputes raised only when payment is demanded are common. We look at what the debtor says against the paperwork and answer it. A genuine dispute changes which route is right; it does not mean the money cannot be recovered.
The debtor company has been liquidated. Is the debt lost?
Not necessarily. You can claim in the liquidation, and a company's liquidation does not usually release a guarantor, so if a director or owner signed a personal guarantee, they may still be liable. Retention money under a construction contract may also be held on trust. See personal guarantees.
The debtor has moved, or changed company. Can you find them?
A change of address, a new company, or a move offshore does not necessarily close an account. We work to locate debtors, and New Zealand judgments can be enforced in Australia.
How long does recovery take?
It depends on the debtor and the route. Many accounts resolve soon after a demand. A statutory demand gives a company 15 working days to pay. Court proceedings and enforcement take longer. Once we have looked at your account, we give you our view of what to expect.
How old can a debt be?
The Limitation Act 2010 generally allows six years from the relevant date to bring a claim for money owed. An existing judgment can be enforced for longer. An old account is worth checking before you write it off.
Do you act outside Auckland?
Yes. We are based in Auckland and work across all of New Zealand through our network of field agents and process servers.
I have received a letter from NZ Debt Recoveries. What should I do?
Contact us before the date in the letter. We act for the creditor named in it. Debtors who engage early usually have more options, including arrangements to pay over time. Call 09 217 1701 or email admin@nzdebtrec.com, quoting the reference on the letter.
General information, not legal advice. This page describes New Zealand law and practice as at October 2026; the right step for a particular debt depends on its facts. Where a matter needs legal advice, we will say so.
Send us the invoice you have been avoiding.
The invoice, your terms of trade, and any correspondence you have. We will tell you whether it is recoverable and what it will take. No cost for that, and no obligation.
