NZ Debt Recoveries Limited ("we", "us") recovers money owed to businesses and individuals across New Zealand. To do that we collect and use personal information, about the people who instruct us and about the people who owe them money. We take that responsibility seriously. This policy explains what we collect, why, who we share it with, and your rights under the Privacy Act 2020.
Who this covers
- Our clients: businesses and individuals who ask us to recover a debt, and the people who act for them.
- Debtors and guarantors: people who owe money that we have been asked to recover.
- Anyone else who contacts us or uses our website.
What we collect
Depending on who you are, this can include:
- names, dates of birth, addresses, phone numbers and email addresses
- employer and business details
- bank account details, so we can pay clients and receive payments
- details of the debt: invoices, agreements, payment history, correspondence
- court and tribunal records, and enforcement documents
- credit information from credit reporting agencies
- records of our calls (we may record and transcribe phone calls), emails, texts and letters
- information you give us through our website, including the online lodgement form
Where it comes from
- directly from you
- from our clients, when they instruct us about a debt
- from public sources, such as the Companies Office, court and tribunal records, property records and the Personal Property Securities Register
- from tracing and search services, field agents and process servers
- from credit reporting agencies
Why we use it
- to recover debts and agree payment arrangements
- to locate debtors and confirm we have the right person
- to take enforcement steps through the courts and the Ministry of Justice, when instructed
- to report to our clients on their files
- to list defaults with credit reporting agencies, where the law allows
- to run our business: accounts, record keeping, and meeting our legal obligations
- to answer enquiries and improve our service
We only collect what we need for these purposes.
Who we share it with
We share personal information only as needed for the purposes above, with:
- our clients, about their own files
- credit reporting agencies (we use Centrix)
- the courts, tribunals and the Ministry of Justice
- field agents, process servers, tracing services and barristers we engage on a file
- our technology and service providers, such as our accounting, email, website, database and artificial intelligence providers
We do not sell personal information.
Credit reporting
We may obtain credit reports on clients (to assess an account with us) and on debtors (to recover a debt), and we may list defaults with credit reporting agencies where the law and the debt allow. We do this under the Credit Reporting Privacy Code 2020.
Storage and security
We store information electronically with reputable providers, using access controls and secure connections. Some of our providers store data outside New Zealand, including in Australia and the United States. We take reasonable steps to make sure they protect it to a standard comparable to New Zealand law.
How long we keep it
We keep file records for seven years, then destroy them securely, unless the law requires us to keep them longer.
Your rights
You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong. We will respond within 20 working days. In some cases the law allows us to withhold information, for example where releasing it would prejudice the recovery of a debt or a court process; if so, we will tell you why.
Debtors: how we hold your information
If we have contacted you about a debt, we usually received your details from the business or person you owe, and from the sources listed above. We hold your information to recover that debt. If you think a debt is wrong, or that we have the wrong person, contact us and we will look into it.
Our website
Our website is hosted on Cloudflare, which collects basic technical information (such as your IP address and browser) to keep the site secure. We use Google Analytics to measure visits; it sets cookies in your browser and sends information about your visit to Google. Information you enter in our lodgement form is checked by Cloudflare's security service and stored in our own database. What you enter in our quick enquiry form is stored in our own database too. If you start the lodgement form and finish the first step (your name and contact details) but do not send it, we keep those details so we can call you and help you finish; we do not email you automatically. We do not use advertising cookies.
